AIMING FOR THE SUPREME COURT TO CHALLENGE NO FAULT DIVORCE IN TEXAS!

A high stakes legal battle has ignited in Texas with the filing of a constitutional challenge seeking to declare “No-Fault” divorce unconstitutional, a move legal experts say could force the Supreme Court to weigh in on the marital contract. The case is currently in the United States Court of Appeals, Fifth Circuit, BOWEN V. BOWEN, CASE #: 26-50249.

Imagine taking sacramental vows at the altar, pledging to stay married for life until death do you part, ....only to be blindsided by a spouse dropping the dreaded divorce bomb, when there has been no fault from which to defend. Under the Texas no-fault divorce statute 6.001, Mary Bowen is subjected to state imposed viewpoint discrimination  about the supportability of her marriage and constrained from putting forth a defense in the family court system.  

When my spouse  pulled the trigger and filed for divorce, I realized that something was terribly wrong with the law.   No-Fault divorce law incentivizes spouses to abandon the family on little more than a whim. Facing the corrupt family court system, the blindsided spouse is left wondering, "Where is justice when my religious viewpoint on sacramental marriage is hijacked, the judge is actually a clerk who rubber-stamps a predetermined outcome, and the system is prejudiced against the respondent out of the starting gate?"
