Bill Whatcott has faced double jeopardy for Gospel tracts he handed out to sodomites in Toronto at a "Pride Parade" over 10 yrs ago.

Bill was fulfilling the Great Commission of Jesus Christ. When he was acquitted of "Hate Speech" in his 2020 trial, the Crown and the Canadian government were angry. They hated Bill so much, they went shopping for a new judge to try Bill a SECOND time.

Bill entered the United States legally in September 2026 on a waiver (Double Jeopardy is unconstitutional in the USA and Gospel tracts are protected speech).

Canada issued a nationwide arrest warrant and formally requested that Bill be sent back to face years in prison.

Bill was apprehended by American CBP Border Guards later in Montana when he went there to pick up his trailer from his friend.

Bill was already acquitted once. He needs legal representation as he sits behind bars to defend against this extradition request.

DOUBLE-JEOPARDY IS NOT ALLOWED IN THE USA, BUT **IS** ALLOWED IN CANADA.

--- Bill is fearful to return to Canada --- Bill is being relentlessly persecuted for Jesus, and even specifically targeted as an example by Canada, to strike fear in other Christians there, and to terminate public Christian dialogue of any kind given the new hate crime laws.

BILL NEEDS TO REMAIN IN THE UNITED STATES AND *NOT* BE EXTRADITED TO CANADA AS HIS ASYLUM PETITION IS HEARD.

Please donate to Bill's fund so we can secure lawyers to defend him against Canada's demand that the State Department send him back there to face prison for the Gospel of Jesus. All the funds collected here will go to Bill's legal defence. Bill needs a Federal Criminal Defense lawyer against Canada's extradition, and also an Immigration lawyer (or one person who can serve in both capacities).

Re: Opposition to Surrender - Extradition Request by Canada for William Gary Whatcott - A-Number

Sent via USPS Express Mail

Dear Office of the Legal Adviser:

I am writing as an interested party to respectfully request that the Secretary of State decline to surrender William Gary Whatcott to Canada. I understand Canada has now formally requested extradition.

I make this request on two grounds for the Secretary's discretionary consideration:

1. Double Jeopardy - Prior Acquittal for Same Conduct.

Mr. Whatcott was tried and acquitted in Canada in 2021 on the same charge now forming the basis of the extradition request. I attended that trial via Zoom.

The second prosecution for the same conduct after an acquittal would be barred by the Double Jeopardy Clause of the Fifth Amendment to the U.S. Constitution if prosecuted in the United States. To surrender a person to face a second prosecution in Canada for conduct for which he was already acquitted is contrary to this fundamental protection in American law.

2. Nature of the Conduct - Peaceful Religious Expression.

The conduct at issue was the peaceful, non-violent distribution of religious gospel tracts in public in Toronto, done in a loving spirit.

At the 2021 trial, Judge Goldstein, who stated he did not share Mr. Whatcott's religious beliefs, found in his judgment of acquittal that Mr. Whatcott did not act out of hate, but out of sincere religious conviction in sharing the gospel.

This is protected religious expression and free exercise.

For these reasons - the prior acquittal for the same charge and the religious, non-violent nature of the speech - I respectfully request that the Department deny extradition and decline to surrender William Gary Whatcott.

Thank you for considering this submission and for including it in the record for the Secretary's review.

Sincerely,

Jonathan William O'Toole
