Our Story Is Your Story: Penn Medicine’s mandatory vaccination policy must be reversed. Thousands of us are standing together to stand up for fundamental rights to freedoms. Stating that someone’s employment will be terminated or altered, if they do not participate in a phase III research trial or receive an experimental medical treatment, is causing duress amongst thousands of faithful healthcare workers! It therefore violates the basic medical principle of informed consent. Coercion, also violates Informed Consent. Coercion is currently being used to bribe those who are willing to take the vaccine, while those who decline the COVID vaccine are denied of the same reward. These healthcare workers will not receive the $1K annual bonus, despite working through the entire pandemic.
We have the right to have our medical information protected under HIPAA. We should not be forced to release or medical information to the Administration or the two physicians making medical decisions on our behalf. This is a violation of medical ethics. Furthermore, our medical exemptions have been tainted by the administration and our physicians are being pigeonholed into only a few extremely rigid categories. ie: Anaphylaxis to PEG. Most workers who submitted a medical exemption with physician signatures and letters, outside of pregnancy, were denied approval of their exemptions. To not allow appropriate medical exemptions violates Title 1 of The American's With Disabilities Act.
We have the right to practice our religion in ways that are meaningful to us as individuals. "The Pfizer/BioNTech and Moderna vaccines used fetal cell lines in their testing stages. Johnson & Johnson used a human fetal cell line called PER.C6, developed from the retinal cells of an 18-week-old fetus aborted in 1985 in its production and manufacturing stages." (1) Many of our healthcare workers have deep religious convictions and feel strongly the vaccine is not appropriate for them. We should not be forced to provide a seven page exemption document to prove our strongly held religious convictions. This is also a fundamental First Amendment Right protecting religious beliefs and practices.
Finally, we have a right under the First Amendment to freedom of speech, to "express ideas, to gather" and to "ask the government to fix problems." We have been restricted and limited in Town hall meetings. We are cut off from access to those who can change the policies. We are degraded and ignored. Our administration has allowed best practices to fall by the wayside. We are deeply concerned about the dangerous adverse events from COVID vaccines for ourselves and families, but most importantly, for our community. We must stand strong; we must stand together, and we will fight for the rights of those seeking healthcare treatment! You are not alone. Join us!

Forcing Vax Status Disclosure Is Political Speech, Suit

Law360 (October 7, 2021, 6:52 PM EDT) -- Requiring workers to disclose their COVID-19 vaccinationstatus is forcing them to engage in political speech, a group of University of Pennsylvania Health System medical workers said in a lawsuit Thursday, claiming that vaccine mandates therefore violate their constitutional rights. According to the complaint filed in Pennsylvania federal court, Penn Medicine required all employees to be fully vaccinated against the virus by Sept. 1 or face adverse employment action, which could include termination. The health system "then began a harassment/embarrassment/shaming campaign against all unvaccinated employees which continues to this day," the workers said.
Pennsylvania Informed Consent Advocates Inc., which is made up of past and present Penn Medicine employees, said that its members have chosen to refuse vaccination or to refuse to disclose their vaccine status for varying reasons. But Penn Medicine has exhibited a "flagrant disregard" of its workers' constitutional rights by requiring all of its employees to be fully vaccinated against the virus, they said. According to the suit, "vaccines have been politicized to a point where receiving or declining a vaccine has become a political act in the eyes of the public, and being compelled into discussing one's vaccine status is compelling that person to engage in political speech." Penn Medicine is essentially a "state actor," which is forbidden from compelling others to express speech or act in a manner that is fundamentally political, the workers said.
They reasoned that the U.S. Supreme Court "has long held that a private entity can become so
involved with or encouraged by the state that its conduct is held to be the equal of state action."
Alternatively, Penn Medicine became a state actor after following the "deep and continuous
encouragement of Pennsylvania state officials encouraging private employers to require vaccination," they said. Therefore, the vaccine mandate is a violation of the First Amendment, the workers said. "UPHS seeks to coerce plaintiff members to engage in political speech in compelling such disclosure by threat to their livelihoods, and to the well-being and fiscal security of persons dependent on plaintiff members' jobs for their survival," they said.
Pennsylvania Informed Consent Advocates also pointed to regulations drafted under the direction of
Secretary of Labor Scott Ketcham and Secretary of Health and Human Services Xavier Becerra
requiring private businesses under their purview to mandate vaccination against COVID-19.
"By requiring workers across America to disclose their vaccination status, defendants Scott Ketcham
and Xavier Becerra are forcing them to engage in un-sought-out, and individually undesirable,
political speech in violation of the first amendment," the workers said. The group is alleging compulsion of political speech, violation of the free exercise clause of the First Amendment, violation of the rights to privacy and bodily autonomy in the Fourteenth Amendment and wrongful dismissal in violation of Pennsylvania public policy.
