Hello, everyone! As y’all may or may not know, I’m going through a very contentious and vicious divorce. The court has ordered regular visitation with my 17-month-old son, Aaron Dylan Graham Jr. (Mr. Baby) until the trial—when a custody determination will be made. Currently, the date for the trial is set for mid-August. (Thanks COVID).
Unfortunately, against the court’s order, to this date, all visitation has been withheld and I have now not seen my son since the 18th of January.
Now, here’s the rub, even though there is a court order mandating visitation, the only way to ensure that the order is complied with is to have a special hearing and prior to that to file two separate motions: one for contempt and one to compel the compliance with the existing order.
The way the family court is run down here during COVID, the Judge sets the docket based on how long the matter has been before her and as these will be new motions, they will be put at the end of the docket.
This means to get our motions heard and ruled on, my lawyer will have to be in court all day from docket call at 0800 until the late afternoon—when our case is actually called.
So, in order to get the court to enforce its existing order and provide for my visitation in accordance with the law, I have to come up with funding for the new hearing.
After the $15,000.00 I’ve put into the case to get it to this point, all of my personal and emergency savings as well as the entirety of my salary has been expended and the retainer for my lawyer depleted.
My lawyer cannot go to court for this hearing until the retainer is replenished. Also, there will be the additional costs of drafting and serving the motions for the hearing and then my lawyer’s hourly fees for the day of the hearing.
To give you an honest appraisal of what Im looking at, the costs for the last hearing in this court came to $9100.00 for the lawyer’s hourly fees—because of the way the court sets dockets and runs hearings.
So I’m asking for help to pay my lawyer to ensure the existing court order is enforced and I am finally allowed to see my son again.
It’s been 2 1/2 months since I’ve seen him at all now.
I’ve not had the resources to do anything about it ...So, I now ask for y’all’s help.
