Amy and Jake Heikkinen

The Café Rosetta is receiving$1,000/day fines from MDHHS that are delivered with daily harassment from Tanya Rule.  Tanya Rule is an avowed Socialist and the Director of Environmental Health in our area.  Tanya Rule uses her positional power daily to harass the law-abiding citizens of the Keweenaw.  The owners Amy and Jake Heikkinen are willing to stand up and take the fight to the Supreme Court if necessary, the least we can do is provide the needed funding.  The funds raised will be used to fund the legal action and PR campaign needed to win this case in the court of Law and the court of Public opinion, for both them and the restaurant industry of Michigan.  The legal fees are anticipated to be between $70,000 and $100,000, the remaining funds raised will be used to pay for the PR campaign.  Their story follows.

Amy and Jake Heikkinen are siblings and partners in Café Rosetta.  In 2013 when working the North Dakota Oil Patch, Jake, single and frugal found himself in the position to invest some of his earnings, he wanted to invest in his hometown of Calumet.  After looking around a bit he decided on a coffee and pastry shop, this initial start was quickly and positively received by the local community.  Within a few months the Café Rosetta morphed into breakfast and lunch place with the help of his sister and soon partner Amy.  Since 2013, Amy, a single mother of 6, threw her love of baking and life-long dream of owning a bakery into the venture and has been the operating partner ever since.  Expanding the business in 2019 by purchasing the building next door.  Amy was living her dream, working hard, while providing for her family and as a by-product created 30 jobs for the local community.  After surviving the first Covid shutdown, in late 2020 everything changed.  Suddenly the draconian, unconstitutional orders, of a tyrannical Governor were reconstituted in another form and forced the pair to make a decision.  The choice was simple, close the doors and lose the business forever or remain open and defend their business and possibly lose it anyway.  When you have 6 children the choice is simple, take care of the family, this meant staying open.
Amy and Jake Heikkinen are naturally shy people of Finnish heritage but they have one thing in spades, “Sisu”, that unique Finnish trait that says come what may we will make it and provides the courage and stubbornness to do what is necessary regardless of the cost.
The stand that Amy and Jake are taking is not unlike that of Karle Manke the Barber who singlehandedly stood down the Governor of Michigan and defeated her in the State Supreme Court.  As with Karl Manke, they will carry the burden for many restaurateurs and could use your help.  Please consider donating generously to support them as they take the fight as far as necessary to defend their God given constitutionally protected rights, by helping them you help secure your freedom too.
“The ones who can “afford” to “wait this out” are the ones who need to stand up, and the ones who cannot afford to “wait this out” are the ones who cannot “afford” to sit out.”

Keweenaw report

Attorney David Kallman says that he expects an agreement between Café Rosetta and the Michigan Department of Agriculture and Rural Development to be reached as early as Tuesday afternoon. That would pave the way for the restaurant to potentially reopen this Thursday pending an on-site examination performed by the agency.
Kallman sounded optimistic and relieved on the phone, with the culmination of weeks of negotiations between the parties nearing its end. A reopening agreement would end all litigation involving the two sides.
We have an appeal pending and that was assigned to the judge in Marquette, and of course they have the case here in Lansing with Judge [Wanda] Stokes. So the discussion at this point is that we would both dismiss our cases.
Café Rosetta’s business license was revoked when it continued operating after the Epidemic Order went into effect in November. Another area restaurant, The Mine Shaft, lost a similar appeal in Marquette’s 25th Circuit Court. Judge Jennifer Mazucchi said that the state legislature had made no mechanism available for such a petition.

Update #14

Friday, 18 December, 2020 (never published by the Daily Mining Gazette) resubmitted on January 2nd 2021.
To the editor:
“If a law is unjust, a man is not only right to disobey it, he is obligated to do so” Thomas Jefferson
In light of the recent attacks on our God given constitutionally protected rights, it is time to say “no more”. The first direct attack on our rights came on March 23rd 2020 when Gretchen Whitmer declared herself dictator of Michigan through issuing a mandate that all people lockdown and stay home. This mandate was ruled unconstitutional in October 2nd, 2020 in a 6 to 1 ruling by the Michigan Supreme Court.
In a free society of educated people this is the end of the story, we move on, we followed our laws, removed the mandate through our legal system it is complete.
In 2020 when our society is dealing with a Government that has a propensity for tyranny it doesn’t end there. These same mandates are copied and pasted into the MDHHS and the Governors operatives were instructed to attack again.
What is a free society to do?
We can petition the government through the courts as was done over the summer. To remove the 1945 law, which the first mandates were executed under the citizens of Michigan collected signatures to remove the law through our legal system. Stand up Michigan collected 538,000 signatures when only 340,00 were needed and did that in record time. The result, 540,000 signatures were pushed to the back room by SOS Jocelyn Benson. Again, a free society worked within the framework of the laws only to be thwarted by a member of Government who believes she is above the law.
We could petition AG Dana Nessel to investigate these petitions and ensure that these petitions are canvassed and the result is enforced, but to what end? Again, we are thwarted by a Government official who actions demonstrate that she believes she is above the law.
To attempt to work within the laws of the State of Michigan any further is to repeat this process and provide support for the definition of insanity, which per Einstein, is to repeat the same thing expecting different results. This will not work when a Governing class, governs as if they are above the law.
Now the attacks are becoming personal and they are in our hometowns. People we know and love are being attacked by citizens of our own community weaponized by the Governor of the State of Michigan. In this case employees of the WUPHD are being used to destroy the lives of our friends and neighbors.

Catherine Beer is the CEO of the WUPHD. She recently defended the acts of one of her charges Tanya Rule, Director of Environmental Health “It’s unfortunate that a public servant who has dedicated her career to serving people of our jurisdiction is being personally attacked for simply doing their job and enforcing and order issued to reduce the spread of Covid-19 and save the lives of our local residents,”.
I ask Ms. Beer and Ms. Rule three questions, first, how does destroying the life of a self-made mother of 6, Amy Heikkinen owner of Café Rosetta, who beat welfare and lifted herself from abuse and poverty and eliminating 30 jobs in Calumet do anything to assist the public health in our community?
Secondly, if the mandates that were struck down as unconstitutional on October 2nd were unconstitutional then, how, after they’ve been cut and pasted into MDHHS regulations, are they constitutional now?
Finally, how can a church of 400 to 500 people, from newborns to octogenarians meet every Sunday since mid-March, without social distancing or masks, not get decimated by Covid-19?
Ms. Beer and Ms. Rule, please provide a logical answer to these three questions. The Nuremburg defense of “we are simply doing our job” will not be accepted. Free citizens, which you are presently, must think much deeper than you appear to be willing to do at present.
This public debate needs to be had, bruised egos and all. The health of our community requires human ties, these ties, which lift our human spirits and affect more healing than any medication ever could are bound tighter in our Churches, Restaurants, Ice Rinks, Community Centers and Bars.
If we as a society do not rise, and demand, on a local level, that these operatives “Cease and Desist” we will no longer be called citizens we will be called subjects and deservedly so.
Merry Christmas! Erik Kiilunen

From Amy and Jake;
“Thank you for the outpouring of support, it is overwhelming and without your support we would have a real hard time believing we could win.
With your support we have retained David Kallman of Kallman Legal, the Attorney who represented America’s Barber, Karl Manke in his battle with our Tyrannical Governor. Kallman legal won the battle in the Supreme Court for Karl, we are prepared to travel the path with David.
Thank you again and please keep us in your prayers.”
From me,
We are just about 20% of the way home! Please share this at least 5 fellow patriots and ask them to participate so we can raise the rest of the funds to support these patriots! All should have a little extra cash with most of the restaurants closed!
