Free Thomas Webster J6 Prisoner: Former USMC, NYPD

Thomas Webster, my devoted husband of 23 years, loving father of our three children, decorated Marine veteran and retired NYPD police officer of 21 years, has been sentenced to ten years in federal prison for assault charges on January 6th.  This is the longest sentence of any J6 defendant to date. 

However, exculpatory video evidence clearly shows a DC Metro police officer violently punched Tom in the face and initiated the whole incident! 

It is heartbreaking for our family to be apart, and extremely frustrating that most Americans do not understand what really happened to Tom.  The Webster family has been struggling with over $300,000 in legal fees, draining our retirement and college tuition savings for our children, in order to fight this legal battle.  After Tom was convicted and sentenced to ten years, he decided to change counsel, and hired a prominent federal criminal appeals firm for direct appeal.  The Webster family needs your help to continue fighting for justice, and FREE TOM!

Here is a brief summary of the incident:  On January 6, 2021 Thomas Webster attended his very first political rally EVER!  At 2pm he arrived at the capitol building and went to the West Terrace – along with thousands of others – after being told there would be a speech.  

As Tom walked closer to the gathering of protestors, the reality of the situation began settling in. Tactics being used by the police were hurting and ultimately killing protestors.  Tom witnessed elderly people covered in blood, terrified children, and people who had been severely injured from projectiles. Women were being assaulted and beaten.

At 2:28pm Tom Webster walked up to a police line, in disbelief at how Americans were being treated by LAW ENFORCEMENT!  He approached the barrier to express his 1st Amendment Right. A Metropolitan PD police officer immediately reacted with very aggressive shoving, instead of de-escalation.  At one point he looks up at Webster’s Marine Corps flag and initiates physical contact – over the barrier!  The officer pushed Webster – the push can be seen from several angles when it happens.  The officer gives no verbal warning! Instead he reaches over the police barricade, lunges, and pushes Webster multiple times.  Frustrated by the Officer’s repeated escalation of physical contact, Webster pushes the bike gate.  With a deliberate wind-up, the officer then punches Webster hard in the face with a GLOVED-HAND.  Webster said the punch hit like a freight train, and he was left seeing stars.  The officer testified that he attempted to push Webster’s shoulder and slipped, hitting his face.  Webster reacts to the hit in self-defense, swinging his flag at the gate rail, never making contact with the officer.  The officer crosses over the gate rail to re-engage Webster.  Webster had backed away from the police barrier and reacts to the officer coming towards him.  Webster waves the officer to stay away. At this point Webster believes the officer is after him.  The officer crossed the gate rail and grabs the flagpole away from Webster. Webster feels the crowd move forward and feels pressure from a red-hatted man behind him.  Tom felt the need to defend himself. The officer then rams the flagpole twice into the side of Webster’s face and mouth.  Webster pushes up the officer’s gas mask but does not strike back.

It is truly despicable that Tom was sentenced to ten years for a brief scuffle that lasted seconds after getting punched hard in the face. THIS ENTIRE INCIDENT WAS CAPTURED ON THE CAPITOL SECURITY CAMERA AND SHOWN TO THE JURY, BUT TOM WAS STILL CONVICTED ON ALL COUNTS.

Tom's Direct Appeal Brief is Filed

Tom's direct appeal brief was filed yesterday, 6/13/23 and the five arguments are: Pretrial publicity caused presumed and actual prejudice; Violation of 6th amendment right to confront witness by excluding all evidence of officer NR's conduct investigations (fatal shooting May 2021); Court committed plain error instructing the jury; Court erred when it sustained a sentencing enhancement for body armor; Sentencing appellant disparately.

A huge thank you to our highly skilled federal criminal appellate legal team.  I am incredibly grateful for everyone contributing to my husband's legal fund and praying for his freedom and our family.  Your love, support and generosity means the world to us.

Our beautiful daughter, a Corporal in the Marine Corps, had not seen Tom since last summer, before he began serving his ten year sentence.  Yesterday, while home on leave, she and I visited him in prison. She was determined to look her best.  When we arrived at the facility, we found out she was not permitted to wear her dress blue uniform in the visitation room.  My daughter showed the highest level of respect and changed into jeans.  I, on the other hand, was a complete mess, sobbing uncontrollably.  I could not hold it in.  My daughter, so proud of her father, always wanting to emulate him, race dirt bikes like him, become a Marine and serve our country like him..... Seeing her in that uniform would have meant the world to Tom and I wanted that moment for my husband and my daughter.  It was a breaking point for me, and I was overwhelmed by hurt, anger, and despair. All my emotions came to a head at once.  Tom should not be in jail.  He is not a criminal.  My husband and my daughter deserved that moment.  One day they will share in that moment.  I pray that our family will be united soon, and I pray for our country to be healed.

This Memorial Day, my prayer is for a STRONG NATION, in honor of the brave men and women who perished defending our freedom

When will people realize J6 persecution is about our basic human God-given rights in a country losing its freedom?

During the month of March I showed the long version of Tom's video and spoke to crowds of good Christian people who care about my husband, and all other defendants being politically persecuted by our own government.  The pastors at these churches welcomed me and other J6 families and defendants, as well as our treasured advocates, into their congregations of worship.  Amazing.

Earlier in the month, in Mississippi, I spoke about how a strong emphasis on faith, family and traditional values brought my own family here.  I have been amazed by the outpouring of support, love and prayers from people in our community, in my prayer group, as well as from a strong state-based advocacy group.  Following my speaking, I answered questions, and there were many.  Most Americans simply do not understand what really happened that day, especially on the West Terrace of the Capitol.  The pastor prayed over us at this church with the attendees, and it was an incredibly comforting and overwhelming experience.

Yesterday, in a church in Alabama, I attended a special event with another J6 wife and her young children, a J6 mother, and a J6 female defendant, along with many advocates.  A number of the J6 prisoners incarcerated in the C2B cell block in DC called in to speak with us at certain points of the program. Tom had been incarcerated with some of these men in DC in 2021.

As presenters, we each addressed a large group of attendees.  I showed Tom's video, others family members spoke about their loved ones, including a brave 11 year old girl whose Daddy is in a max facility.  A female defendant told her incredible story and shared the stories of the 4 American protesters killed that day, and one badly beaten.   People were dumbfounded by the level of political persecution, and the hardships these men and women and our families are enduring.  The truth makes people angry.  Maybe that's why some people choose to just ignore our families and accept what truly happened? 

We prayed, we came together.  At the conclusion of the program, all of the J6 prisoners in DC called in, and we all sang the national anthem together.  I got the chills and had tears in my eyes. This country and our freedom are worth this fight. 

The kindest women prepared and served us dinner.  It was a heartwarming blessed day for us all.

I know God always wins, and I continue to trust in him to bring my family and others back together.  Please continue to pray for us!

I came across this picture of Tom, beaming, holding our first born daughter minutes after she was born. Some people say newborns do not smile, but she clearly is smiling at her Daddy in this photo.  At my husband's sentencing, someone in the room said maybe after ten years his kids will look at him as a hero again.  Our three children will never stop looking up to their father, and he will always be their hero.  He's my hero too, and we want him home.

I visited Tom on my own yesterday, and we talked, laughed and both became quite emotional.  We continue to discuss the path to his freedom, and find comfort in the truth!

Tom and I are excited for our future together, to have our family reunited, to renew our wedding vows one day, and to live the happy life we have always enjoyed with each other. 

God has a plan for our family, and we continue to turn to him during this difficult time.  As a reminder of my trust in Him, and in honor of my Tommy, the Holy Spirit is now inked on my right inner wrist.  "For the Lord is the Spirit, and wherever the Spirit of the Lord is, there is freedom."

Thank you for remembering our family.  For all your prayers, love, support, letters, and generosity.

Happy New Year to our family, friends, supporters and all J6 defendants and their families.  The Webster family sincerely hopes justice will prevail, and we are prayerful for Tom's release in 2023!

I visited Tom yesterday with my son, and he is so humbled and grateful for everyone's support, prayers, letters and cards.  A million thanks!

As the anniversary of J6 nears, my husband would like everyone to pray that our country may be restored in faith, hope, love, unity and peace.  May God's truth always prevail!
