Hello Faithful Fundraisers!

An update to our timeline! Attorney Ray Smith III has filed our appeal and we await a response from FCS. Due to the holidays, this process will be painfully slow - we should hear something from the appeals court after the first of the year. 

Appeals Court Decision:
a. The appeals court can grant some of our arguments and reject others. It’s not all or nothing. The appeal has MANY issues it is arguing.
b. Whatever aspects of the appeal are ‘granted’ will be sent back to trial court to be argued again.  

To be clear, when we sat before Judge Dunaway on October 1 that WAS our ‘day in court’. We are now in the appeals process. Any points ‘granted’ by the appeals court simply means we get to have another shot proving that point in trial court. 

Timeline:
August 25th – Engagement letter signed hiring Ray Smith III to represent families of Fulton County School children.

September 13th – On or around this date all 11 families completed and signed their affidavits.

September 17th – Filed Complaint

October 1st – TRO hearing

October 5th – TRO Denied by Judge Dunaway

November 19th – Appeal Filed

Ray and his team (with help from Jeff Childers from Florida) are on track and our job is to support their efforts by raising funds. Through Givesendgo, Gofundme, and donations made directly to Smith & Liss, we have raised over $95,000!

We can’t stop now! We need our loyal contributors to keep up the good work of spreading the word, raising funds, and continuing personal contributions. Thanks to everyone’s generosity we have been able to keep up with the hours billed.

Thank you to all our donors and families who have been standing up to fight the overreach of Fulton County School Board and Superintendent Dr. Looney. Our lawsuit has been sitting in appeals for months, and we have finally heard from the court.
 
Due to Governor Kemp and our General Assembly’s push to pass SB 514,  “Unmask Georgia Students Act”, our lawsuit has been deemed ‘moot’. SB 514 gives Georgia families what we were looking for, the right to opt out of facemask mandates: 
 
“No local board of education shall make or enforce any rule pursuant to subsection (a) of this Code section that requires students to wear face masks or face coverings while present in any area of a school or school grounds or other property owned or operated by the local school system unless such a rule provides that a parent or guardian of a child enrolled in such local school system my elect for his or her child to be exempt from such rule. A parent or guardian makes such election shall not be required to provide a reason or any certification of the child’s health or education status. No student shall suffer any adverse disciplinary or academic consequences as a result of such election by a parent or guardian.” (SB 514 - this act is repealed in its entirety June 30, 2027)


To be clear, this means the lawsuit is OVER and we now have the right to opt out of masks should the county attempt another mandate.

Hello Faithful Fundraisers!
Whoever said the wheels of justice grind slow but grind fine was not kidding! The process of suing Fulton County Schools grinds on!

We are thankful most FCS are currently mask optional however that does not stop us from moving forward as they can reinstate the mandate at any time (just ask Crabapple Elementary School parents).

We’ve had some good press on the case with Ray talking to AJC and WSB and on November 8th Brietbart covered our story after speaking with Philip Holloway and Christy McCranie.

Here’s where we are:

Hello Happy Fundraisers!

Here is the update on our appeal!
1. We are waiting on the clerk's office to bundle the record.
2. Then we will await the docketing notice from the court of appeals.
3. After we receive that, we will have 20 days to submit our brief.

As always we need weekly/monthly contributes in order to keep paying Ray and his team for their outstanding work! I reread our case this week to refresh myself on the details so I can speak with fresh insight as I explain our case to others. I recommend you do the same. Good Evening Plaintiffs,


Judge Dunaway made a decision today, not in our favor… I am enclosing the order denying our Judge Dunaway made a decision today, not in our favor… He denied our request for a temporary restraining order.

We probably all feel about the same about this result, disappointment. 

As we let that sink in remember we’ve been told many times this is a marathon not a sprint. Our attorneys continue to say we will experience some losses and some wins. Know that much of what is being done is staging for the larger battles ahead. 

Ray Smith, Ashely Loyd, and Jill Wright did a phenomenal job Friday. We are thankful for their courage and composure under pressure. They continue to give us hope that we will move forward toward victory one step at a time!

Thanks to the 241 of you who logged in to show your support and concern for Fulton County children.  Keep spreading the word!!  We have just begun to fight!  We will let you know the next step as we are informed!

Our lawsuit will be filed the first of next week. I look forward to moving forward with our brave families and generous donors in holding our school system accountable for their overreach!

Today Fulton County Schools sent us their Mitigation Matrix. If you’re like me, you found it a frustrating setup to virtual school. While Roswell, Milton, and Alpharetta numbers look comparatively low, many kids in other areas will soon be starting virtual school. I’m glad they will be able to breathe fresh air, but how horrible for their mental health.
The decision Fulton County Schools force on parents regarding their children…
Physical Health vs. Mental Health
Fresh air working from home = isolation
Socializing with friends at school = side effects from hours/days masked up
Furthermore…
Who’s responsible for the health of these children?
Mom and Dad or Dr. Looney?
Who will be there to help the children when they fall behind due to quarantining or depressed due to isolation?
Mom and Dad or Dr. Looney?
The battle is big and broad, and I wish we could fight on all fronts! We have chosen a specific, pointed plan of attack because it has proven successful in reversing the mask mandates. Furthermore, I’m hopeful we will set the stage to protect parental rights moving forward!
