My name is Attorney Deborah Silver.
I am handling an election case.
My clients are Dasha Pruett, Gregory Stenstrom and Leah Hoopes.
Dasha Pruett was a political candidate who ran for the U.S. House of Representatives in the 2020 General Election.
Greg Stenstrom is a fraud and tech expert, as well as a poll watcher observer, who was appointed by Donald Trump and Candidate Thomas Killion, who ran for re-election to the Pennsylvania Senate (he lost his re-election bid, unfortunately).
Leah Hoopes is a committee woman and poll watcher observer, who was appointed by Candidate Craig Williams, who successfully ran to represent District 160 in the Pennsylvania House of Representatives.
We all reside in Delaware County, Pennsylvania. Our election case was filed in Delaware County, in the Delaware County Court of Common Pleas in Media, Pennsylvania, against the DELCO Board of Elections.
Our petitions to intervene and for sanctions against the Board of Elections were both denied by Judge Capuzzi, the judge whose Order we were seeking to enforce, by way of contempt sanctions.
We also requested that the Board of Elections be declared guilty of a misdemeanor for violating the Election Code provisions as to observers.
Thereafter, on February 11, 2021, Stenstrom and Hoopes filed a Pro Se Appeal, and a Notice of Appeal, appealing Judge Capuzzi's Order dismissing our case, with the Commonwealth Court, the intermediary appellate court, hoping to reverse Judge Capuzzi.
On that same day, February 11, 2021, the Board of Elections, through its Duane Morris lawyers, Manly Parks and Nicholas Centrella, filed a Petition for "Counsel Fees," which is nothing but a disguised sanctions request because our case was dismissed because of perceived lack of standing, like many election cases across America.
The Members of the Board of Elections asked Judge Capuzzi to issue an Order, forcing my clients, Pruett, Stenstrom and Hoopes, to pay their lawyers, Manly Parks and Nicholas Centrella, a whopping $19,224.56 in legal fees!
This is what I have been fighting ever since.
The last significant payment I received on account of my unpaid legal fees was made to me in early January of 2021.
Since that significant payment I received in early January, I have not been paid any significant sum, notwithstanding that I put in well over 100 hours since then, working on the election case, both before and after our election case was thrown out by Judge Capuzzi on January 12, 2021.
This includes the extensive time I recently spent preparing an Opposition to the Petition for Counsel Fees, and a Memorandum of Law in Opposition to the Petition for Counsel Fees, since February 11, 2021, until the present, February 19, 2021, and my work on these pleadings is ongoing.
Our response in opposition is due on March 3, 2021. I have been working around the clock to defeat this unjust attempt to make my clients pay their legal fees, when it should be the other way around.
It is the Board of Elections that has "unclean hands," was "contemptible," and "unconscionable," yet Judge Capuzzi falsely accused my clients and I of these things when he hurled insults against us in his scathing Opinion dismissing our case based on a perceived lack of standing.
I have been threatened multiple times by the lawyers for the Board of Elections, with sanctions. They threatened to report me to the Disciplinary Committee of the Pennsylvania Bar, when I have done nothing wrong.
In fact, I am a hero, patriot and a rock star, according to my clients, fighting for integrity in our elections.
I have tried to hold the members of the Board of Elections accountable for their lawless conduct.
Their misbehavior includes their flagrant violation of Judge Capuzzi's Order, the Election Code and both recent and long standing Pennsylvania Supreme Court case law precedent, all of which state that observers have the right to be present in the room where mail-in ballots are opened, handled and counted, until the counting has been completed, AT ALL HOURS!
The members of the Board of Elections completely kept out observers from a rear mail-in ballot resolution room at the Wharf Office Building in Chester, Pennsylvania, for 3 days, from November 3-5, 2020, and then only let observers in that rear room for 5 minutes every 2 hours, and not at all hours, as required by law.
If they can manipulate documents and people during an impeachment trial to fit their corrupt narrative, they can certainly do it to our elections.
I have since learned from Exhibit C-1 to the Petition for Counsel Fees that Manly Parks and Nick Centrella spent 3.3 hours preparing and editing a letter seeking sanctions against me, the Petitioners' Counsel.
These lawyers are trying to obtain an Order from Judge Capuzzi which will force my clients to pay for their legal fees for time spent trying to sanction, suspend, and perhaps, even disbar my clients' own lawyer!
What a disgusting unjust travesty of justice we are seeing unfold before our very eyes!
I, for one, will not take this lying down. And neither will my clients.
I am fighting for my clients, while at the same time I am also fighting to continue practicing law in the future, which is my sole profession.
Sometimes I feel very alone in what may be the biggest battle of my life.
I need your help.
I am doing this alone, by myself, taking on the Board of Elections, their lawyer, Solicitor William Martin, and their Duane Morris attorneys, Manly Parks and Nicholas Centrella.
I know that with God I will have the victory. God will destroy my enemies.
They are trying to take me out once and for all, to silence me, so I cannot represent anyone else in the future.
To them, I am their enemy, when all I have done is to try and enforce the law, and not to change it.
This is the cancel culture, to intimidate clients and their attorneys, in election cases, so candidates in the future will be unable to obtain legal representation, and good luck trying to find a lawyer to represent you.
We must stop them or we will never again have a free, transparent and fair election. If we don’t all fight for integrity in our elections we will not have any.
That is something every American should want.
Everyone needs to step up and do what needs to be done, to fight the utter lawlessness of the members of the Board of Elections.
If they get away with this, they will be emboldened, to do this and worse in future elections.
I have reached out to Trump impeachment lawyers, Mike Van Der Veen, and Bruce Castor, both of whom are willing to review my pleadings and to assist us in opposing the Petition for Counsel Fees, but they require a $25,000 retainer.
My clients today starting their own fund raising effort on the Give Send Go platform, to raise the $25,000 needed to pay this retainer, and to pay me for my unpaid legal fees.
Litigation is expensive. Lawyers are in business to earn money. They have bills to pay, to rent an office, to pay their employees.
I am a sole practitioner. I have worked many hours for which I have not received any compensation.
With God all things are possible. No weapon formed us shall prosper.
These are the times which try men's souls. We are engaged in a battle for the very soul of our nation.
To the Democrat leftists which control the White House, the U.S. Congress, and the left wing fake news lame stream media -- the fraud, illegalities, irregularities and lawless conduct by the Board of Elections, is all "one big lie." They said this repeatedly at Trump's impeachment trial.
Courts across America, including Judge Capuzzi in our own election case, dismissed our petitions based on a perceived lack of standing, without ever giving us an evidentiary hearing, which we requested.
Because of this, the mountain of evidence of fraud, illegalities, irregularities and misconduct by the Board of Elections was never even heard, let alone, considered and weighed, by anyone!
Yet Judge Capuzzi called our case baseless, without even a "scintilla" or "smidgen" of evidence to support it, even though he never allowed my clients their day in court, and did not give them the opportunity for due process, to present eye witness testimony that would prove, once and for all, that the members of the Board of Elections flagrantly violated a court order, the Election Code and Supreme Court case law, as to observers.
Please do your part. I cannot fight them alone, Judge Capuzzi, and the Board of Elections.

It will soon be too late to hire Attorneys Mike Van Der Veen and Bruce Castor to assist me if my clients do not raise the $25,000 for their retainer.
I will file the opposition and memorandum of law which I prepared, on my own if necessary.
As to Attorneys Mike Van Der Veen and Bruce Castor, we really need them. It would really help our case if my clients can raise the $25,000 to pay their legal retainer.
Three heads are better than one. I know that their collaboration with me could make all the difference, between winning and losing. And make no mistake, we cannot afford to lose.
This is a battle. We cannot afford to lose this battle.
We cannot afford to allow the Board of Elections to get away with their unjust Petition for Counsel Fees against my clients, which was filed to silence and intimidate them. And to punish them for doing nothing other than seeking to hold the Board of Elections accountable for their failure to comply with the law.
They should be paying for my clients' legal fees, rather than the other way around.

Update #7 — Disciplinary Complaint against me filed by DELCO Solicitor William Martin dismissed on June 9, 2021

Contributions needed to help me pay my legal fees which I incurred having to respond to a bogus disciplinary complaint against me filed by DELCO Solicitor William Martin.

Almost a week ago I learned that DELCO Solicitor William Martin’s complaint against me with the Disciplinary Board was dismissed as of the Board’s June 9 letter.

Praise the Lord God almighty.

My response was submitted May 26, it took the Board 14 days to investigate and decide to dismiss the complaint against me, which I received back on April 28.

Rejoice with me!

The poll watcher observers were kept from the rear room where the mail-in ballots were being opened, handled and counted in violation of a court order and the Election Code, which states that the poll watcher observers are allowed to be present at all hours that the mail-in ballots are being resolved (which means opened, handled and counted).

Instead of being allowed to be present "at all hours," only 2 observers were allowed to be present for up to 5 minutes every 2 hours, which cannot be "full compliance" with the court order or the Election Code, which requires observers to be allowed to be present "at all hours."

That is what the underlying election case was about.

Seeking sanctions for contempt of a court order, a declaratory judgment to hold the members of the Board of Elections in contempt, and that those members are guilty of a misdemeanor under the Election Code, for violating the provisions stating that observers are allowed at all hours that the mail-in ballots are being opened, handled and counted, until the ballots are fully counted.

The Election Code sets forth specific penalties for interfering with the abilities of the poll watcher observers to be present during the ballot resolution process, in the discretion of the court: a fine of up to $1,000, and a prison sentence of up to one year.

These provisions have been in the Pennsylvania Election Code since it was enacted in 1937.

Hello everyone!

On or around April 28, 2021, I was emailed a Disciplinary Complaint against me which was filed with the Disciplinary Board of the Pennsylvania Bar by DELCO Solicitor William Martin.

None of the persons listed in the Disciplinary Complaint against me were contacted at all, with the exception of two, who were not known to my investigators to be current employees of the Board of Elections when my investigators made contact with them.

I would appreciate your prayers for favor with, and justice from, the Disciplinary Board who is reviewing the Disciplinary Complaint against me.

I have retained excellent counsel to prepare a response on my behalf, which response must be submitted by May 27, 2021. Please pray for wisdom and favor for my attorney.

I thank God for providing good legal representation for me. I had to pay a large retainer. It is worth it since my career and reputation is on the line.

If you want to donate towards my unpaid legal fees in the election case I handled, or towards my attorney fees to defend me against the Disciplinary Complaint that has been filed against me, I would be very grateful.

I was fighting for integrity in our elections, and did nothing wrong.

I Update: Appellate brief filed Monday April 19.


In the Commonwealth Court of Pennsylvania. 

Please pray for favor with the panel of judges that is assigned to read and decide our appeal, of Judge Capuzzi’s two orders denying our petitions to intervene and for sanctions against the Board of Elections, with prejudice.

We want the appellate court to reverse Judge Capuzzi, remand case back to DELCO Court of Common Pleas, have an evidentiary hearing and to hold the Board of Elections in contempt and guilty of a misdemeanor for violating a court order and the Election Code.
